KOTA KINABALU:High Court ruled that TYT’s action to dissolve DUN is “non-justiciable” at all. If this judgement is not overturned, then it is a dangerous precedent. Rule of Law would be replaced by Rule by man. What if the TYT decided to dismiss a Minister without the advice of the CM? What if he conferred a Datukship to a notorious convict? What if he insisted on pardoning that convict against the advice of the AG? Surely, such actions of the TYT are justiciable. What if the TYT dissolves DUN without being advised by the CM? Sabah would be ruled by a TYT for life whose illegal actions cannot be challenged, not even in a court of law. Remember, the 2-term limit on the TYT has been abolished in December 2018. The TYT can rule for life. I would have no issue if the dissolution of DUN is eventually held to be valid. But I have serious concerns that the action of the TYT is non-justiciable at all. This is a very dangerous precedent that must be overturned by the Court of Appeal or the Federal Court.-
