KOTA KINABALU: The High Court today fixed the 3rd of September to hear Datuk Shafie Apdal’s application to strike out the Originating Summons filed against him by Chief Minister Tan Sri Musa Aman.
A statement by Musa’s lawyer Tengku Fuad Tengku Ahmad stated that Musa had on the 6th June 2018 filed an originating summons against Tun Juhar and Datuk Shafie for, among others, a declaration that Musa Aman is the rightful Chief Minister of Sabah, that Juhar had acted unconstitutionally in swearing Shafie in as Chief Minister after he had already sworn in Musa and for a declaration that Shafie is not the lawful Chief Minister and all acts caused or done by him are void or voidable.
High Court Judge Datuk Yew Jen Kee directed the parties to file their affidavits and submission before the 13th August and has reserved the 3rd of September for her decision on Shafie’s striking out application.
‘In the event that Shafie’s striking out application is dismissed, the Court will fix a date upon which to hear Musa’s claim against both Tun Juhar and Datuk Shafie’ said Tengku Fuad Tengku Ahmad, lead Counsel for Tan Sri Musa.”
Tengku Fuad, Suku Vanugopal and Christine Gloria Linus appeared for Musa while Datuk Douglas Lind appeared for Shafie. Tun Juhar was represented by the State Attorney-General’s Chambers.-pr/BNN
